A building permit is required for decks greater than 16 inches above the lowest grade and exceeding 120 square feet, and for all decks, regardless of size, that are:

  • Located in a proposed or designated Baltimore County Historic District
  • On the Baltimore County Landmarks List
  • Located in the floodplain
  • Located in the Chesapeake Bay Critical Area

Required Documents

You must provide the following when submitting your permit application.

  • Under 600 square feet—Site plan
  • 600 square feet and over—Construction plans and site plan
  • Over 3,000 square feet—Signed and sealed plans by a design professional licensed in the state of Maryland
  • If property is served by a well and septic system, a site plan must be provided that complies with the Ground Water Site Plan Requirements.
