Department of Justice Hiring Discrimination Lawsuit against Baltimore County Police Department - Notice of Settlement and Fairness Hearing

The United States of America has sued Baltimore County, Maryland alleging employment discrimination under Title VII of the Civil Rights Act of 1964 (“Title VII”).  The lawsuit alleges that the Baltimore County Police Department’s (“BCPD”) use of written examinations to select entry-level police officers and police cadets since January 1, 2013 discriminated against African American applicants on the basis of race. The United States did not allege that the County intentionally discriminated against African American applicants.

The United States and Baltimore County have voluntarily entered into a Settlement Agreement to resolve this lawsuit.

Baltimore County has agreed to provide money (sometimes called “back pay”) and other relief awards to individuals who would have otherwise been eligible for employment as an entry-level police officer or police cadet if the County did not use the written examinations the United States challenges. Baltimore County has also agreed to stop using the challenged written exams and to use an exam that meets the required legal standards.

African American individuals may be eligible for a relief award if they:  

  • Took and failed one of the challenged written exams between January 2010 and April 27, 2019; and 
  • Met the minimum qualifications for employment when they failed any of the challenged written exams.

Individuals who do not meet the above requirements are not eligible for a relief award.

If you are African American and took and failed the written examination to become a police officer or cadet between January 2010 and April 27, 2019, and have not received written notice of the Settlement Agreement by mail or email, call JND Legal Administration toll-free at 1-833-722-0886 immediately to update your contact information.

If you want to object to the Settlement Agreement, you must return an objection form by February 16, 2021. The objection form and instructions for completing the objection form are available at www.BaltimoreCountyPoliceSettlement.com.

Objections to the Settlement Agreement will be considered by the District Court at a Fairness Hearing on Tuesday, April 6, 2021 at 10 a.m.
